Termination:
You may cancel your service at any time with 90 days' notice. Contract Terms may apply. We reserve the right to terminate your service if you violate these terms.
Governing Law:
These Terms of Service are governed by the laws of Mexico.
Dispute Resolution:
Any disputes arising from these terms will be resolved in the courts of Mexico City.
Changes to Terms:
We may update these terms from time to time. We will notify you of any significant changes.
Limitation of Liability:

Cheq Pay SAPI de CV is in no way responsible for any economical losses of loss of data from the final customer.

Anticorruption Declaration

I certify that Cheqpay and its affiliated companies have informed me of their stance regarding anti-corruption policies and the compliance of third parties hired by Cheqpay and its affiliated companies with these policies. I certify that I understand the requirements of Cheqpay and its affiliated companies’ prohibition on all forms of corruption and certify that neither I nor my company have taken, nor will take, any action in connection with the proposed relationship with Cheqpay and its affiliated companies that violates this prohibition. Additionally, I certify that my company has complied, and will comply, with all applicable anti-corruption laws, including the United States Foreign Corrupt Practices Act (FCPA) and the laws of the United Mexican States, and that it has not made, offered, or authorized, nor will it make, offer, or authorize, any payment, gift, promise, or other benefit, whether directly or indirectly through another person or entity, to any government official or member of their immediate family, for the purpose of influencing official actions or decisions to gain an improper business advantage. I understand that Cheqpay and its affiliated companies will base their decision to enter into a contractual agreement with me or my company on the information provided, and that any false or misleading information will be grounds for immediate termination of the agreement. I understand the requirements of applicable anti-bribery and anti-corruption laws and the prohibition by Cheqpay and its affiliated companies on all forms of corruption, and I certify that neither I nor my company have taken, nor will take, any action that violates these laws or prohibitions.

Privacy Policy

Pursuant to the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDPP) and other applicable regulations (hereinafter, the "Responsible Party" or "Operator", with registered office and address for service at Av. Santa Fe 462, Santa Fe, Cuajimalpa, CP. 05348), we hereby expressly inform you that:

Your personal data will be processed for the following original and necessary purposes: a) To provide the services expressly contracted in the service agreement; b) To ensure the functionality and quality of the contracted services, including the issuance of credentials that CHEQ PAY S.A.P.I. DE C.V. deems appropriate to guarantee the correct functioning of the platform; c) To control, manage and define the type of activities that, based on the data you have provided, you can carry out on the platform (including, where applicable, users thereof); d) To send communications regarding services to be provided by CHEQ PAY S.A.P.I. DE C.V.; e) To invoice for the services provided, as well as to collect payment judicially or extrajudicially.
Subject to any modification to this Simplified Privacy Notice, the following constitute additional purposes for the processing of your personal data: a) Sending information and commercial offers about products and/or services offered or produced by third parties, related to the service. If you do not wish to receive communications with the type of information indicated above, please check the following box: /___/ I do not wish to receive commercial or promotional information about products and/or services from third parties related to my service.
Sensitive personal data: The Responsible Party must collect personal data considered sensitive under applicable law. Therefore, and in view of the activities and services contracted under your service, we require your express written consent for the processing thereof: /___/ I consent to the Responsible Party processing my sensitive personal data for the purposes indicated.

Note:

LFPDPP is the acronym for the Federal Law on the Protection of Personal Data Held by Private Parties in Spanish.
"Sensitive personal data" in this context refers to data that reveals racial or ethnic origin, genetic information, religious beliefs, philosophical or moral convictions, union membership, political opinions, sexual preferences, health data or biometric data.
